Welcome to niqobz.

The terms "we", "us" and "our" refer to niqobz. niqobz operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). niqobz is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced herein, describe your rights and responsibilities when you use the Services. Please read them carefully. By visiting, interacting with, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our Services.

1. Who we are and how to contact us

1.1 Who we are. We are niqobz, a modest wear brand built for the women with standards. We are based in Singapore and powered by Shopify.

1.2 How to contact us. You can reach us at hello@niqobz.com. We aim to respond to all enquiries promptly.

1.3 How we may contact you. If we need to get in touch, we will email you at the address you provided in your last order.

2. Access and account

2.1 By using the Services, you confirm that you are at least 18 years old, or that a parent or guardian is involved in your use. You may give consent for minor dependents to use the Services on devices you own or manage.

2.2 To use the Services, you may be asked to provide information such as your email address, billing, payment, and shipping details. You confirm that all information you provide is correct, current, and complete.

2.3 You are solely responsible for keeping your account credentials secure and for all activity on your account. You may not transfer, sell, or assign your account to anyone else.

3. Placing an order

3.1 Orders are placed through our website. Once you’ve added the product(s) you’d like to your basket, you’ll go through our checkout procedure where you’ll need to enter your contact details, delivery and billing information. Please check, double check and even triple check your order (e.g. the product(s), size(s) and delivery address) before completing your purchase.

3.2 Acceptance of your order. Your order is an offer from you to us to buy the product(s) in your basket. After you place an order, you will receive an email from us confirming we have received it. Our official acceptance of your order takes place in Singapore when we email you to confirm we’ve dispatched your product(s). It’s at this point that a contract will come into existence between you and us. When we acknowledge your order, we’ll also confirm your order number. If you need to contact us about your order, you should quote this number.

3.3 We must receive and process your payment before your order is accepted. Please note that we may be unable to accommodate cancellation requests once an order is accepted.

3.4 Purchases are for your own personal or household use only. They are not for commercial resale or export.

4. Our right to cancel or suspend your order

4.1 If we cannot fulfil your order. In the unlikely event that we’re unable to fulfil your order (e.g. because the product is out of stock, we haven’t been able to verify the billing information you’ve provided, or you have requested delivery to a country that we do not currently ship to, or there has been an error in the pricing or description of the product), we’ll let you know by email and we won’t charge you for the product.

4.2 Unusual or suspicious activity. We provide our products for your personal use only. We may cancel an order if we notice something unusual or suspect that our products are being exploited for any commercial, business or re-sale purpose. If you believe we have made a mistake, please contact us at hello@niqobz.com.

4.3 Suspending supply. We may have to suspend supply of a product to deal with technical issues, comply with changes in law, or make updates to the product as notified to you.

5. Our products

5.1 What we provide. We provide niqabs and modest wear accessories. Designed for everyday comfort, breathability, and quality. Each piece is made with intention. If something is not right, we want to hear from you.

5.2 Product descriptions. Images on our website are for illustrative purposes only. We work to display colours accurately, but we cannot guarantee that your device's display will exactly match the product. All product descriptions are subject to change without notice. We reserve the right to discontinue any product or limit quantities at any time.

5.3 Gift cards. Gift cards are available for purchase like any other product. Please note:

5.3.1 you cannot purchase a gift card using another gift card;

5.3.2 gift cards may only be redeemed on the store from which they were purchased;

5.3.3 gift cards have no expiry date; and

5.3.4 inactive gift cards will not be charged or reduced in value over time.

6. Prices and billing

6.1 The price charged will be the price in effect at the time your order is placed and will be confirmed in your order email. Posted prices do not include taxes, shipping, handling, customs, or import charges unless otherwise stated.

6.2 Prices are subject to change without notice. If you have already placed an order, you will be charged the price that was in effect at that time.

6.3 If a product is incorrectly priced and we identify this before dispatch, we will charge the correct lower amount or contact you before proceeding. If a pricing error is obvious and could reasonably have been recognised as a mispricing, we reserve the right to cancel the order, issue a full refund, and request the return of any products already sent.

6.4 You confirm that your payment information is true, correct, and complete, that you are authorised to use the payment method provided, and that you will pay all charges including applicable taxes and shipping.

7. Delivery

7.1 Where we ship. For details on delivery destinations, please see our Shipping Policy.

7.2 Risk and title. The risk of loss for products purchased from us passes to you upon our delivery to the carrier. Title for products purchased from us transfers to you upon payment for the products.

7.3 Delivery costs. All delivery charges are set out in our Shipping Policy.

7.4 Delivery times. Delivery timelines depend on the shipping method you select at checkout. During promotional periods, delivery may take a little longer.

7.5 We are not responsible for delays outside our control. If your delivery is delayed by something outside our control (such as carrier delays, customs, or weather) we will let you know as soon as possible. If the delay is substantial, you may contact us to cancel your order and receive a full refund for any undelivered products.

7.6 Missed deliveries. If you are not available when delivery is attempted, the courier will notify you and advise on how to rearrange delivery or collection.

8. Your rights

8.1 Faulty or misdescribed products. If your item is faulty or does not match how it was described on our website, you may have a right to a replacement or refund. Please contact us at hello@niqobz.com with your order number and a photograph of the issue within 14 days of receiving your order.

8.2 Ending the contract. You may end the contract and receive a full refund for any products not yet supplied if:

8.2.1 we have told you about a change to the product or these terms that you do not agree to;

8.2.2 we have told you about a pricing or description error and you do not wish to proceed;

8.2.3 supply may be significantly delayed due to events outside our control;

8.2.4 we have suspended supply for technical reasons for more than four weeks; or

8.2.5 you have a legal right to end the contract because of something we have done wrong.

8.3 Changing your mind. We offer a 14-day return window from the day you receive your item. You will need to cover the return postage. Your purchases are subject to return or exchange solely in accordance with our Return & Refund Policy.

9. Returns and refunds

9.1 To start a return, please refer to our Return & Refund Policy or contact us at hello@niqobz.com. Please do not send items back without contacting us first, returns sent without prior approval will not be accepted.

9.2 Refunds will be made to your original payment method. If a discount code was used, the refund will reflect the discounted amount paid. We will process refunds within 14 days from the date we receive your return or proof of postage, whichever comes first.

9.3 We may end the contract and retain the right to a refund for products not yet provided if you do not provide information we need to fulfil your order or do not allow delivery within a reasonable time.

10. Discount codes

10.1 We may release discount codes ("Codes") from time to time via email or other marketing channels. To apply a Code, enter it at checkout and click "apply."

10.2 Please note:

10.2.1 Codes are valid for a limited time only as stated in the relevant communication.

10.2.2 Unless otherwise stated, Codes apply to full-priced items only and cannot be used on sale items or to purchase gift cards.

10.2.3 Only one Code may be used per order. Codes cannot be combined with other offers.

10.2.4 Codes are non-transferable and cannot be exchanged for cash.

10.2.5 Codes cannot be applied to delivery charges.

10.2.6 Returned items will be refunded at the discounted price paid. If a qualifying spend threshold is no longer met due to a return, the offer value may be deducted from your refund.

10.2.7 We reserve the right to reject orders where a Code is invalid or has been used fraudulently, and to withdraw, amend, or extend offers at any time.

11. Intellectual property

11.1 Our Services, including all trademarks, brand names, text, images, graphics, video, audio, product content, and the design and arrangement thereof are owned by niqobz or its licensors and are protected by applicable copyright, trademark, and intellectual property laws.

11.2 These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, publicly display, download, store, or transmit any material from the Services without our prior written consent. All rights not expressly granted are reserved by niqobz.

11.3 niqobz's names, logos, taglines. Including "For the girls with standards" and "For us, by us" designs, and slogans are trademarks of niqobz. Shopify's name, logo, and marks are trademarks of Shopify Inc. You must not use any of these without the respective owner's prior written permission.

12. Third-party links and tools

12.1 The Services may contain links to third-party websites or tools that we do not monitor or control. We provide access to any such tools "as is" and "as available" without warranties of any kind. Use of third-party tools or websites is entirely at your own risk. Please review the relevant third party's policies before engaging with them.

12.2 Complaints, claims, or questions regarding third-party products or services should be directed to that third party.

13. Relationship with Shopify

niqobz is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with niqobz. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and niqobz, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with niqobz.

14. Feedback

If you submit feedback, reviews, or suggestions ("Feedback"), you grant us a perpetual, worldwide, royalty-free licence to use, reproduce, modify, publish, and distribute that Feedback for any purpose, including to improve and promote the Services. You confirm that you own or have the right to submit the Feedback, and that it does not violate the rights of any third party. We are under no obligation to maintain Feedback in confidence or to compensate you for it.

15. Our responsibility for loss or damage

15.1 We are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable.

15.2 We are not liable for indirect or consequential losses, including lost profits, lost revenue, lost savings, or loss of data, even if we have been advised of the possibility of such losses.

15.3 Where we are liable, our total liability shall not exceed the amount you paid for the product(s) in the relevant order.

15.4 Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other matter where it would be unlawful to do so.

15.5 We supply products for personal use only. We have no liability for business losses if products are used for commercial purposes.

16. Prohibited uses

You may use the Services for lawful purposes only. You may not use the Services to violate any laws; infringe the intellectual property rights of others; harass, harm, or impersonate any person; transmit spam, malware, or viruses; scrape or extract data using automated tools; or circumvent any security measures. We reserve the right to terminate your access without notice if you violate these Terms.

17. How we use your personal information

18. Other important terms

18.1 Transfer. We may transfer our rights and obligations under these Terms to another organization, and will notify you if we do so. If you are unhappy with the transfer, you may contact us to end the contract within seven days and receive a refund for any unprovided products. You may not transfer your rights under these Terms without our written consent.

18.2 Entire agreement. The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and governs your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service). Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

18.3 Severability. In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

18.4 No waiver. If we delay in enforcing this contract, we can still enforce it later.

18.5 Changes to these Terms. You can review the most current version of the Terms of Service at any time on this page. We reserve the right, in our sole discretion, to update, change, or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. We will notify you of any material changes to these Terms in accordance with applicable law, and such changes will be effective on the date specified in the notice. Your continued use of or access to the Services following the posting of any changes to these Terms of Service constitutes acceptance of those changes.

18.6 Governing law. These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the federal and state or territorial courts in the jurisdiction where niqobz is headquartered. You and niqobz consent to venue and personal jurisdiction in such courts.

18.7 Indemnification. You agree to indemnify, defend and hold harmless niqobz, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities or claims, including reasonable attorneys' fees, payable to any third party due to or arising out of (1) your breach of these Terms of Service or the documents they incorporate by reference, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services. We will notify you of any indemnifiable claim, provided that a failure to promptly notify will not relieve you of your obligations unless you are materially prejudiced. We may control the defense and settlement of such claims at your expense, including choice of counsel, but will not settle any claim requiring non-monetary obligations from you without your consent (not to be unreasonably withheld). You will cooperate in the defense of indemnified claims, including by providing relevant documents.
